Supreme Court Blocks Business Vaccine Rule, Declines to Stay Health Care Worker Mandate

The Supreme Court has blocked the Biden administration’s COVID-19 vaccine mandate for private businesses, but has decided to allow a separate regulation that requires health care workers to get a vaccine to take effect.

In a 6–3 ruling on Jan. 13, the court halted the mandate for all private employers with 100 or more workers, ruling that the states and companies that challenged the rule were likely to succeed. Biden administration officials had argued that the Occupational Safety and Health Act (OSHA) of 1970 gave them the authority to impose the mandate, but a majority of the justices disagreed.

“Applicants are likely to succeed on the merits of their claim that the Secretary lacked authority to impose the mandate. Administrative agencies are creatures of statute. They accordingly possess only the authority that Congress has provided. The Secretary has ordered 84 million Americans to either obtain a COVID–19 vaccine or undergo weekly medical testing at their own expense. This is no ‘everyday exercise of federal power.’ It is instead a significant encroachment into the lives—and health—of a vast number of employees,” the majority slip opinion reads.

The ruling came from Justices John Roberts and Samuel Alito, George W. Bush appointees; Clarence Thomas, a George H. W. Bush appointee; and Justices Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett, all Trump appointees.

Justice Breyer, a Clinton appointee, and Justices Sonia Sotomayor and Elena Kagan, both Obama appointees, dissented. They wrote in their dissent that the law in question didn’t limit the labor secretary’s powers.

The majority “[imposed] a limit found no place in the governing statute,” the minority opinion reads.

“Not so,” the majority wrote. “It is the text of the agency’s Organic Act that repeatedly makes clear that OSHA is charged with regulating ‘occupational’ hazards and the safety and health of ’employees.’”

While Solicitor General Elizabeth Prelogar in an earlier brief didn’t dispute that OSHA is limited in regulating “work-related dangers,” she claimed that the risk of contracting COVID-19 qualifies as such a danger.

“We cannot agree,” the majority opinion reads. “Although COVID-19 is a risk that occurs in many workplaces, it is not an occupational hazard in most. COVID-19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases. Permitting OSHA to regulate the hazards of daily life—simply because most Americans have jobs and face those same risks while on the clock—would significantly expand OSHA’s regulatory authority without clear congressional authorization.”

The ruling means that the mandate is blocked while the case goes back to the U.S. Court of Appeals for the 6th Circuit, which overturned a stay that had been imposed by a different appeals court.

OSHA is part of the Department of Labor.

Missouri Attorney General Eric Schmitt, a Republican who brought one of the challenges against the mandate, said in a statement that the ruling was “a massive win for millions of workers and businesses across the country, including Doolittle Manufacturing here in Missouri, who would’ve had to shutter their doors if this mandate was not halted.”

“While we’re disappointed in the Supreme Court’s ruling on our lawsuit against the health care worker vaccine mandate, that fight is far from over, and the case is still ongoing,” he said.

Schmitt was referring to a majority of justices agreeing to lift lower court orders that blocked a separate Biden administration mandate imposed by the Department of Health and Human Services’ Centers for Medicare & Medicaid Services (CMS).

The CMS mandate, which doesn’t allow a testing opt-out, covers more than 17 million health care workers.

Congress granted authority to the health secretary to promulgate, as a condition of a health care facility’s participation in Medicare and Medicaid, requirements that he or she “finds necessary in the interest of the health and safety of individuals who are furnished services in the institution,” the majority of the court stated in their ruling.

While a vaccine requirement has never before been imposed, “we agree with the government that the Secretary’s rule falls within the authorities that Congress has conferred upon him,” the majority opinion reads.

The justices said getting a COVID-19 vaccine would “substantially reduce the likelihood that health care workers will contract the virus and transmit it to their patients.” However, this doesn’t align with studies and real-world data on the effect of vaccination against the Omicron coronavirus variant.

“The rule thus fits neatly within the language of the statute. After all, ensuring that providers take steps to avoid transmitting a dangerous virus to their patients is consistent with the fundamental principle of the medical profession: first, do no harm. It would be the ‘very opposite of efficient and effective administration for a facility that is supposed to make people well to make them sick with COVID-19,’” the majority opinion reads.

The narrow 5–4 opinion saw Roberts and Kavanaugh join the Democrat-nominated trio of justices, while Thomas offered a dissent that was joined by Alito, Gorsuch, and Barrett.

Thomas said that the government hadn’t made a strong argument that it was likely to succeed in the case, stating that the administration didn’t establish that the Medicare Act or any other law gives it the authority to impose a vaccine mandate in order for facilities to participate in Medicare or Medicaid.

“These cases are not about the efficacy or importance of COVID-19 vaccines. They are only about whether CMS has the statutory authority to force health care workers, by coercing their employers, to undergo a medical procedure they do not want and cannot undo. Because the Government has not made a strong showing that Congress gave CMS that broad authority, I would deny the stays pending appeal. I respectfully dissent,” Thomas wrote.

Cases involving the health care mandate will now go back to appeals courts for disposition.

Biden released a statement cheering the decision to lift the stays on the health care mandate, saying it “will save lives.”

“At the same time, I am disappointed that the Supreme Court has chosen to block common-sense life-saving requirements for employees at large businesses that were grounded squarely in both science and the law,” he said.

The Minnesota School Board Association (MSBA) has terminated its membership with the National School Boards Association (NBSA), joining a growing number of states to do so over a highly controversial Biden administration letter, which likened concerned parents to domestic terrorists.

“The MSBA Board of Directors acted last week to terminate our membership with NSBA,” a letter from the nonprofit organization to school board chairs and superintendents dated Jan. 4 states.

It comes after the NBSA sent a letter (pdf) to President Joe Biden on Sept. 29, 2021, characterizing disruptions at school board meetings as “a form of domestic terrorism and hate crime.” The organization also urged the federal government to invoke counterterrorism laws to quell “angry mobs” of parents seeking to hold school officials accountable for teaching Marxist critical race theory and for imposing COVID-19 restrictions such as mask mandates on their children.

Just five days later, on Oct. 5, U.S. Attorney General Merrick Garland issued amemo directing federal law enforcement to help address an alleged “disturbing spike in harassment, intimidation, and threats of violence” against teachers and school leaders. The memo remains in effect, despite the NSBA having since apologized for and rescinded the letter.

“Prior to the letter to the Biden administration, we had ongoing concerns regarding the value of membership with the NSBA,” MSBA Executive Director Kirk Schneidawind wrote. “With 18 other state school board associations already terminating their membership, we felt it was important to reevaluate the value and consider what will be in the best short- and long-term interests for MSBA and its members.”

Schneidawind said the decision “was not taken lightly,” noting that MSBA plans to form a new Consortium of State School Boards Associations (COSSBA) alongside the other 18 state school board associations who have terminated their memberships with the NBSA.

“The executive directors and staff from the 18 state associations have already created a structure with enormous opportunity,” said Schneidawind. He added that COSSBA will allow the group “to design and build a multi-state association for today and the future.”

Meanwhile, newly surfaced emails suggest that the U.S. Department of Education might have played a more important role than previously thought in the creation of the letter.

According to email exchanges obtained by advocacy group Parents Defending Education (PDE), the NSBA letter appears to be a response to a request for information by U.S. Secretary of Education Miguel Cardona.

It comes comes amid questions over the Biden administration’s involvement in the creation of the NSBA letter, which still serves as the basis of a series of actions taken by the Justice Department.

“We are confident that this new opportunity, through a multi-state association, will support and strengthen our efforts in building high performing school boards in each of our school districts,” MSBA’s statement concluded.

With the New Year’s Eve passing, 2021 is now the second year defined by the CCP (Chinese Communist Party) virus pandemic and the global response to it. Compared to 2020, last year was not only deadlier, but also more complicated. Issues such as virus variants, vaccine resistance, and vaccine efficacy have come to the forefront. Mandatory vaccination went from a “conspiracy theory” to official policy in a matter of months. Increasingly prominent were also legal battles over government restrictions on the population, with approaches taken by different states further diverging.

Although 2021 started with a massive wave of COVID-19-related hospitalizations, there was also an expectation that the pandemic would soon end or at least fade into the background. Vaccination was billed as the ticket to normalcy, and initially it looked that way. By mid-June, about 180 million Americans had received at least one does of one of the approved vaccines and even states with the most authoritarian approaches, such as New York, had lifted most of their restrictions.

Delta

However, the respite was brief. In July, infections started to spike again. The CCP virus mutated into a new variant, dubbed Delta, which appeared to be less deadly, but more infectious. Vaccine uptake slowed down and Delta appeared to be somewhat more resistant to it. The solution presented by authorities was to take yet another shot of the vaccine—a “booster.”

The virus also showed signs of seasonality. In the winter, it pummeled the northeast, but not so much the south. In the summer, the situation seemed to reverse.

In August, President Joe Biden, plagued at the time by what was widely panned as a botched withdrawal from Afghanistan, announced a major policy shift—mandatory vaccination for government workers, contractors, and even private employers with over 100 employees. Just months earlier, the administration was dismissing the idea of vaccine mandates. Any suggestion that the government may force people to take the novel vaccine, still in the process of long-term clinical trials, was even ridiculed by some as a “conspiracy theory.”

Soon after Biden’s announcement, some Democrat-heavy states and localities followed with various mandates of their own, with New York City spearheading the effort. Bit by bit, New York had mandated the shot for government workers, private school staff, most indoor establishment workers, and even patrons of gyms, entertainment venues, and restaurants. To see a movie, exercise, or eat indoors, a New Yorker now must show proof of “full” vaccination, which for now does not include boosters, as well as photo ID. Outgoing Mayor Bill de Blasio also added a mandate for all private employers and the state mandated the vaccine for all health care workers.

Legal challenges to the mandates have been a mixed bag of failures and partial victories. Oftentimes, courts would block the mandate only to later allow it to go into effect. Challenges to Biden’s mandate for private employers are expected to be heard by the Supreme Court.

Another phenomenon associated with Delta was an increase in severe illness and even deaths among children. While in 2020, about 0.05 percent of all COVID-19 deaths were children, the number rose to 0.1 percent in 2021, according to CDC, making for a total of 678 deaths associated with COVID-19. For comparison, the agency recorded 358 pediatric deaths during the 2009-2010 flu pandemic.

Omicron

With the winter approaching, about 50 million Americans got booster shots. If that was to give them a sense of security, however, it would be short-lived. Out of South Africa emerged a yet new variant capable of wide spread, named Omicron. There are indications that vaccines and to a lesser extent natural immunity acquired through previous infection only provide limited resistance to Omicron. On the other hand, the variant appears to be yet more infectious, but again, less lethal than Delta, with reports of much milder symptoms and far fewer deaths worldwide.

The Centers for Disease Control and Prevention estimates that Omicron comprised about half of COVID-19 infections in the week ending Dec. 25. Those are modeled projections, though, as data from its variant surveillance system lags about three weeks.

Omicron or not, hospitalizations attributed to COVID-19 have surged in the northeast. New York Gov. Kathy Hochul responded by again requiring people to wear masks in indoor establishments, regardless of vaccination.

Republican-led states have generally gone in the opposite direction, not only refraining from mandates, but sometimes even outlawing them. Florida went as far as expressly prohibiting local governments and school districts from imposing mask and vaccine mandates on their staff or in their facilities. The state, led by Republican Gov. Ron DeSantis, also restricted private businesses from imposing vaccine requirements by carving out a number of exemptions, including for health concerns and prior infection. Florida legislature even authorized the state to ditch federal Occupation and Safety Hazard Agency (OSHA) and create its own to preempt Biden’s vaccine mandate, which OSHA should enforce.

Information War

Last year has also been marked by a number of revelations regarding what appears to be a lack of candor on part of a number of experts and public officials.

A series of documents released under Freedom of Information requests showed that a group of experts, including NIH head Anthony Fauci, coordinated efforts to discredit the theory that the virus originally escaped from a lab in Wuhan, China. The evidence, in fact, appears to lean in that direction. But Fauci et al. have a personal stake in hiding those indices as they were involved in financing or conducting dangerous “gain-of-function” experiments with coronaviruses at the Wuhan Institute of Virology. Fauci explicitly denied to Congress his NIH funded such research, only for a growing stack of evidence to indicate otherwise.

The information tug-of-war around potential therapeutics expanded last year. In addition to hydroxychloroquine, some doctors also tried off-label prescriptions of anti-parasitic drug Ivermectin. In one episode, popular talk show host Joe Rogan was both praised and vilified for taking Ivermectin upon announcing he tested positive for the virus. He then invited CNN’s Sanja Gupta on his show and criticized his network for claiming he took a “horse de-wormer,” when in fact he took the human formulation of the drug as prescribed by his physician.

Study results on both hydroxychloroquine and Ivermectin remain mixed. Some show improved results in patients under certain circumstances, while others do not.

Conversations regarding the vaccines’ safety also morphed. After initial claims of no serious side effects, authorities have gradually shifted toward acknowledgement that some serious side effects, such as myocarditis, do occur.

Administration

The Biden administration’s handling of the pandemic has been mixed. The administration managed a smooth rollout of the vaccines, but after the initial wave, the uptake has since slowed down. Gallup reported in November that the percentage of adults who are or plan to get vaccinated plateaued at 80 percent. By Dec. 30, over 205 million people were “fully” vaccinated, meaning 2 shots of the vaccines that require them. Over 68 million got boosters as well, leaving about 23 percent of the adult population.

A December poll by the Trafalgar Group found that a large majority of American likely voters opposed new mandates and restrictions, regardless of new variants (pdf).

After months of promises to tackle the pandemic, Biden recently conceded that there’s “no federal solution” to it. The year concluded with over 450,000 deaths attributed to COVID-19 and over 33 million detected infections. That’s up 27 percent and 67 percent respectively from the year before.

The nation’s recent lockdown policies and mask mandates will create a generation of children who exhibit lower IQs and signs of social brain damage, according to a clinical psychiatrist for children and adolescents.

Dr. Mark McDonald cited an Aug. 11 study by Brown University (pdf) that found that “children born during the pandemic have significantly reduced verbal, motor, and overall cognitive performance compared to children born pre-pandemic,” during an interview with host Cindy Drukier on a Dec. 25 episode of NTD’s “The Nation Speaks.” NTD is a sister media outlet of The Epoch Times.

The masks, “Zoom schools,” and lockdown mandates have led to “deprivation overall, of social contact, [of] not being able to see faces, being stuck at home all day long, [and this] has actually caused brain damage to the youngsters,” he said.

In another interview in the episode, professor Carl Heneghan, the director of Oxford University’s Centre for Evidence-Based Medicine, cited evidence that pandemic restrictions and the “fear we instill into children” has led to the worsening of psychological problems.

Heneghan cited his Oct. 2 study, which concluded that “eight out of 10 children and adolescents report worsening of behavior or any psychological symptoms or an increase in negative feelings due to the COVID-19 pandemic.”

“School closures contributed to increased anxiety, loneliness and stress; negative feelings due to COVID-19 increased with the duration of school closures,” the study reports. “Deteriorating mental health was found to be worse in females and older adolescents.”

Adolescents above the age of 12 also did worse than children under 12, as adolescents face increasing peer pressure, social pressure, and are more aware of messages being delivered globally, according to Heneghan.

“The first thing is to deescalate any fear and anxiety around COVID for children,” Heneghan said. “For children, [COVID] is actually a very safe disease” and children shouldn’t be worried about the impact of COVID “on themselves or their future health.”

He said that “shutting areas like schools was a mistake,” as keeping them open is good for education, “social connectedness, and well-being.”

“We should really prioritize education and those interventions that are in children’s best interest,” he said.

According to a Dec. 20 study, data from the U.S. Centers for Disease Control and Prevention also showed that mental health-related visits in 2020, when pandemic restrictions were first imposed, increased by 24 percent in 5- to 11-year-olds and 31 percent in 12- to 17-year-olds, compared to 2019 data.

Anecdotally, McDonald noted that he’s seen children who “refuse to make eye contact, who are wetting their pants or wetting the bed at night, cannot go to sleepovers—being away from their mother for extended periods of time.”

Teenagers, on the other hand, come out of lockdown restrictions being “so wrapped up in social media and phones and Zoom school because they’ve been trained for the last year and a half, that they do not even want to go out anymore,” he said.

McDonald called the government and media corporations out for creating a “behavioral conditioning program,” in which children are subjected to “irrational, ridiculous” situations such as eating outside on a 40-degree day and having to run marathons or play sports with masks on.

As of Dec. 27, the Biden administration is recommending that children “too young to be vaccinated” should be “surrounded by vaccinated people and mask in public indoor spaces, including schools,” according to the COVID plan on the White House website. “For those adolescents aged 12 and above who are eligible for vaccination, the most important step parents can take is to get them vaccinated.”

As of Dec. 27, the website states that “over half of the nation’s adolescents have been vaccinated.”


The vaccine does not prevent Covid, but actually spreads the Chinese Virus. The evidence is right before your eyes for all to see.
