White House Can’t Mandate COVID Jabs for Federal Contractors: Appeals Court

A federal appeals court on Monday struck down a White House rule requiring anyone employed by a federal contractor to be vaccinated against COVID-19 as a condition of government contracts.

A three-panel judge of the Fifth Circuit Court of Appeals voted 2-1 to affirm a lower court judgment that barred President Joe Biden’s September 2021 executive order in three states after Louisiana, Indiana, and Mississippi sued to challenge the rule.

These three states sued the Biden administration in the Western District of Louisiana in their capacities as federal contractors themselves, winning an injunction and stay by the district court.

In upholding the lower court finding, Judge Kurt Engelhardt, an appointee of former President Donald Trump, said in his majority opinion (pdf) that a broad interpretation of the law could have given Biden “nearly unlimited authority to introduce requirements into federal contracts.”

He illustrated his point by saying that Biden could “hypothetically” mandate that all third-party federal contractors’ employees reduce their BMI (body mass index) below a certain number based “on the theory that obesity is a primary contributor to unhealthiness and absenteeism.”

The U.S. government has contracts with hundreds of third-party contractors, and judges have indicated that the issue might affect up to 20 percent of American employees.

Indiana Attorney General Todd Rokita touted the ruling as a legal victory against what he called President Joe Biden’s executive overreach.

Rokita, who joined with two other plaintiff states in the legal action, decried Biden’s “truly unprecedented” use of the federal Procurement Act to wield executive power to impose the mandate on third-party contractors.

“Hoosiers and all Americans should have the liberty to make their own decisions on whether to get vaccinated,” Rokita said in a statement. “That includes individuals who happen to work as federal contractors. No one should have to fear losing their jobs just because they opt against getting a shot.”

Louisiana Attorney General Jeff Landry called the appeals court’s decision a “victory for freedom.”

“We will continue to stand up against these abuses of power that threaten us now and in the future,” he said in a statement.

‘Intrusive Command’

The Department of Justice (DOJ) defended the mandate in a court filing, saying Biden’s executive order, issued on Sept. 9, 2021, was justified under the Federal Property and Administrative Services Act of 1949, known as the Procurement Act.

The DOJ had argued in an earlier court filing that “requiring entities that enter into federal contracts to have a vaccinated workforce enhances the efficiency of federal contractor operations,” per the Procurement Act.

Engelhardt said that if Biden had issued an alternative but similar executive order targeting tobacco—mandating that workers refrain from smoking or being in the presence of smoking—it would “undoubtedly strike reasonable minds as too great a stretch under the Procurement Act.”

“No such provision exists in the Procurement Act to justify this intrusive command,” the judge wrote. “The pandemic, challenging as it has been for the President, the legislature, the courts, and especially the populace, does not justify such an enormous and transformative expansion of presidential authority.”

The lower court originally found that the states had Article III standing as they faced a choice between complying with the mandate and potentially losing employees or becoming ineligible to bid on or renew federal contracts.

The district court found that Biden’s mandate fell afoul of the Tenth Amendment, which entrusts the “safety and the health of the people” to the politically accountable officials of the states.

‘Truly Unprecedented’

The appeals court found Biden’s executive order unlawful and a “truly unprecedented” use of procurement regulation to “force obligations on individual employees.”

“When an agency claims to discover in a long-extant statute an unheralded power to regulate ‘a significant portion of the American economy,’ we typically greet its announcement with a measure of skepticism,” Engelhardt wrote. “We expect Congress to speak clearly if it wishes to assign to an agency decisions of vast ‘economic and political significance.’”

However, Congress didn’t authorize “such a dramatic shift” in the president’s power under the Procurement Act, he noted.

“Nor are historical exercises of that power sufficient to demonstrate a long-standing understanding that the Procurement Act could be used in this way,” he wrote. “The President’s use of procurement regulations to reach through an employing contractor to force obligations on individual employees is truly unprecedented.”

Judge James Graves, an appointee of former President Barrack Obama, said in his dissenting opinion that this was the first executive order under the Procurement Act to be struck down.

“When actions taken are in the mainstream of American businesses, that points towards permitting the executive order,” Graves wrote. “Economic factors would prevent the president from handicapping the contractor workforce with extreme contractual terms.”

Graves disagreed with the BMI comparison, saying that if a president tried to impose “draconian measures outside the mainstream of American companies,” he or she would face opposition from the public or Congress.

Stephanie Arnold was already a mother to two young girls, but when she became pregnant with her third child, she had a bad feeling.

It wasn’t pregnancy jitters; it wasn’t fear of the unknown — it was a premonition.

“I knew 100 percent I was going to die giving birth to my son,” Arnold told Today. She told everyone — her friends, her family, her doctors. She made public posts — goodbye letters — on social media, and she knew months before her due date that she was going to die on the operating table.

‘I told everyone who would listen.’

Where was this coming from? Why was she being morbid?

Friends and family were worried about her, and doctors didn’t quite believe her, dismissing her concerns as just nerves.

But it wasn’t just that; Arnold knew very specifically that she was going to die on the operating table, suffer kidney failure, and even need a hysterectomy (removal of the uterus). It was like she had a precise but horrible vision of what was to come.

One of the last people she told was her anesthesiologist during her last medical consultation before her delivery.

It felt like a useless phone call wherein Arnold received no help; the anesthesiologist had walked her through what recovery would look like, and then Arnold asked what would happen in the very specific case that things played out like her vision.

“She said she was startled by it,” Arnold said.

But even though Arnold hung up feeling like the anesthesiologist didn’t help, it ended up being the crucial tie-breaker.

The anesthesiologist ended up flagging Arnold’s file and incorporating extra blood and a crash cart in her operating room.

It ended up making all the difference.

Arnold ended up delivering a healthy baby boy earlier than her due date. She started bleeding and had to be rushed to the hospital. She said goodbye to her 18-month-old daughter through her tears, knowing it would be the last time she would see her.

And then things ended up playing out exactly like her vision. Three seconds after her son was born, she died.

Arnold flatlined for 37 seconds, and during that time, she saw the medical staff who sprang into action, she saw which nurse was giving her CPR, she saw what was going on with her daughter down the hall in another room, she saw her anesthesiologist at the foot of her bed, and she saw her doctor standing beside her saying over and over again, “This can’t be happening. This can’t be happening.”

Arnold’s blood wasn’t clotting, she had a heart attack, her kidneys were failing, and she had to get a hysterectomy just like she had seen in her premonition. The human body usually has 20 units of blood — she was given 60 units.

If the extra blood and crash cart hadn’t been on hand, Arnold would not have been resurrected.

It turned out she had an amniotic fluid embolism — where the amniotic fluid gets into the mother’s bloodstream, a rare 1-in-40,000 occurrence, and Arnold happened to be allergic to the fluid, causing a horrific reaction.

When Arnold came out of her medically induced coma, she was traumatized. Everything she feared would happen came to pass, and she ended up seeking therapy to help work through it.

‘I woke up … and I cried, and I cried, and I cried.’

But out of those regression therapy sessions, Arnold learned that she knew a lot of things she shouldn’t have been able to know.

Later, when she asked her doctor whether she’d said “This can’t be happening,” her doctor was shocked. She told Arnold that she did, but only in her head.

Arnold had known what her husband was wearing even though he had been getting off a plane and nowhere near her; she’d known what her daughter was doing down the hall; what the doctors and nurses were doing during the 37 seconds where she was technically dead. There was no way for her to have been conscious or aware of any of that.

She had had an out-of-body experience.

“I have no explanation of it all,” one of her doctors told her.

‘I can’t give you a medical explanation for all of this. You need to go spiritual.’

What really sealed Arnold’s belief that she’d had a spiritual near-death and out-of-body experience was one little boy she saw during those seconds.

There was a little boy who looked a lot like her childhood girlfriend, and she supposed that it could have been her brother who had passed away as a child. Except she’d never met this boy.

During this time, the little boy told Arnold, “Tell my sister that I miss the way she twirled my hair.”

It made no sense to her, but during Arnold’s recovery, she called up her friend to ask if this meant anything to her.

When she did, her friend dropped the phone and just broke down crying.

She told Arnold, “I used to do it every night to put him to sleep.”

As a child, Arnold was intuitive to the point of practically having premonitions, but it went away as she got older. But the months leading up to her third pregnancy cranked her sensitivity up high.

She did her research thoroughly afterward as well. She sorted through many near-death experiences and read what other experts had to say for or against these theories while making up her mind.

Her own doctors had told her that, normally, someone in her situation would not have survived, or if they did there was such a high chance of lasting neurological damage, and none of it happened to Arnold.

Then she compiled her research and her interview with her doctors in the aftermath and wrote a book, titled “37 Seconds,” to tell her story.

Arnold knew what she saw had to be true.

She had gone through a traumatic experience, and the months leading up to it were terrifying, but she came out the other side feeling blessed.

“Not a day goes by that I don’t feel blessed. Not a day goes by that I don’t appreciate life,” she said.

Hunter Biden’s abandoned laptop has reared its ugly head again, as it reportedly contains emails that appear to back up Russian claims that the US president’s son was involved in financing military research into dangerous pathogens at biolabs in Ukraine.

Biden helped arrange millions of dollars in financing for Metabiota, a Pentagon contractor that specialized in researching pandemic-causing pathogens that could be used as bioweapons, the UK’s Daily Mail outlined on Friday, citing newly obtained emails and letters from the computer. The president’s son and his partners in a firm called Rosemont Seneca also invested $500,000 in the contractor.

At least one of the documents suggested that Metabiota’s interest in Ukraine went beyond research and money-making. An executive with the contractor, Mary Guttieri, explained in an April 2014 memo to Hunter Biden of “how we can potentially leverage our team, networks and concepts to assert Ukraine’s cultural and economic independence from Russia and continued integration into Western society.”

Another memo showed that Biden had pitched a “science project” involving Metabiota and Burisma, the Ukrainian natural gas company where Biden made millions of dollars as a board member. His pay was cut by half after his father’s stint as US vice president ended in January 2017.

The revelations come one day after Russian military officials alleged that US agencies and high-level Democrats, including Hunter Biden, have been involved in backing bioweapons research in Ukraine. The officials cited documents that had been seized by Russian soldiers in the former Soviet republic.

However, some Western media outlets dismissed the claims as Russian propaganda meant to justify Moscow’s military attack on Ukraine. In many cases, the allegations were brushed off or ridiculed without even taking them seriously enough to include a US government response. For instance, the Daily Beast declared in a headline, “Russia ramps up the crazy,” while state-funded NPR and other outlets referred to the accusations as “false” or “propaganda” without any apparent probing of the facts. Even the Daily Mail itself, before obtaining the latest Biden emails, said Russia had ramped up its “wild propaganda campaign” by making its bioweapons claims.

The reaction echoed the response in October 2020, when the New York Post broke a story alleging overseas influence-peddling by the Biden family, citing emails obtained from a laptop that Hunter had abandoned at a Delaware repair shop. Spreading the report was blocked on social media, where the Post was censored, and mainstream media outlets suggested that the scandal was the result of a Russian disinformation campaign.

Thus, the original scoop was essentially buried just weeks before Biden was elected president, in an extraordinary case of media bias. However, last week, the New York Times admitted that the laptop and its contents were authentic.

Government records show that Metabiota was awarded an $18.4 million contract by the Pentagon, the Daily Mail added. Emails showed that Hunter Biden claimed to be helping the contractor “get new customers,” including government agencies.

As this equation was coming together in my mind, I saw parts and pieces scattered amongst a sea of people, who picked these raw materials up. Working together, they began to build. The items each person brought, became tools in their hands for some, but for others became parts for structures or machinery, and in some cases, even art. They came forward and gathered above  those corn rows, atop that great platform. And emblazoned across the front of that platform, I could see the word, “MAGA,” glowing brightly like neon. The people on the platform were those who would Make American Great Again; the workers, inventors, builders, parents raising children, and teachers, all these with Scriptures in hand which were, for each of them, a word or directive from God. Steve Bannon, former chief strategist to President Donald Trump, has revealed Joe Biden’s son emailed a shop owner who had his hard drive in an effort to get it back. The revelations come as the New York Post this week released an expose detailing links between Joe Biden and his son who was paid at least $50,000 a month to sit on the board of a Ukrainian energy company who allegedly set up a meeting with the then-Vice President. Information regarding Hunter Biden’s relationship with the Ukranian energy company was sourced from a collection of emails recovered from a laptop that was allegedly dropped off at a repair shop in 2019 and later given to the FBI. It was a water-damaged MacBook Pro and the person who dropped it off never paid for the service and didn’t retrieve it or a hard drive on which its contents were stored – according to the shop owner who said he repeatedly tried to contact the customer. Sky News host Sharri Markson said the owner of the repair shop in Biden’s home state of Delaware says when he did not hear back from the FBI, he made a copy of the hard drive and gave it to Donald Trump’s lawyer, Rudy Giuliani. Emails on the laptop revealed that Hunter Biden had planned to introduce his father – the then-Vice President – to an executive at Ukrainian energy company Burisma, a company where Hunter served on the board of directors. Publicly, Biden has said he’s never spoken to his son about his overseas business dealings. These emails seem to indicate otherwise. In one message sent by Vadym Pozharsky in April 2015, he wrote: “Dear Hunter, thank you for inviting me to DC and giving an opportunity to meet your father and spent (sic) some time together. It’s realty (sic) an honour and pleasure.” In response to this news, Facebook and Twitter both censored the article from the New York Post, advising they were “limiting the distribution” of the story on their platforms until a third-party contractor can “fact check” the article. Mr Bannon told Ms Markson, “Hunter Biden’s lawyer has come to us both with phone calls and with emails saying, ‘hey, I’ve got to get the hard drive back’.” “This is not some Russian intelligence operation; they admit it’s their hard drive,” Mr Bannon said. “We have the emails from the Lawyer, if we need to release them, we’ll release them.”
